1. Acceptance & Eligibility
These Terms of Service govern your access to and commercial transactions through Bareilly Co. (operating in Ontario, Canada). By viewing our olfactory catalog or submitting an order, you confirm that you have reached the age of majority in your Canadian province or territory of residence and agree to be bound unconditionally by these terms.
2. Currency & Canadian Taxation
All prices quoted on Bareilly Co. are denominated in Canadian Dollars (CAD). In accordance with Canada Revenue Agency (CRA) regulations, applicable Harmonized Sales Tax (HST), Goods and Services Tax (GST), or Provincial Sales Tax (PST) is calculated automatically at checkout based upon your destination delivery province:
- Ontario: 13% HST applied.
- British Columbia, Manitoba, Quebec, Saskatchewan: Applicable federal GST (5%) plus corresponding provincial sales tax.
- Alberta, Yukon, Northwest Territories, Nunavut: 5% GST only (Zero provincial sales tax).
- Atlantic Canada (NB, NL, NS, PE): 15% HST applied.
Because all inventory is cleared through Canadian customs prior to warehousing in Ontario, clients will never receive retroactive customs bills, broker fees, or import duties from Canada Border Services Agency (CBSA).
3. UAE Formulations & Maceration
Bareilly Co. imports authentic extraits and eau de parfums directly from Dubai, United Arab Emirates (including official houses Lattafa, Arabiyat Prestige, Swiss Arabian, Maison Asrar, Afnan, and Rasasi).
Arabian extraits are concentrated aromatic formulations (typically 20%–32% oil concentration). Due to the natural character of raw agarwood (oud), ambergris, and floral absolutes, subtle batch-to-batch variations in color hue or maceration development over time are standard marks of authentic artisan fragrance chemistry and do not constitute defective merchandise.
4. Domestic Order Execution
Orders submitted before 2:00 PM EST on Canadian business days are packaged and inducted with Canada Post or local expedited courier on the same business day. Delivery timeframes (1–2 business days for Ontario/Quebec, 2–4 business days for Western & Atlantic Canada) represent courier estimates. Bareilly Co. provides end-to-end tracked delivery with signature options for high-value flacon allocations.
5. Limitation of Liability
To the maximum extent permitted under applicable Canadian consumer protection legislation, Bareilly Co. shall not be liable for indirect, punitive, or consequential damages resulting from courier transit delays beyond our reasonable operational control. In any event, our total liability shall not exceed the purchase price paid for the specific flacon or decant in dispute.
6. Governing Law of Ontario
These Terms of Service and any contractual sales arising hereunder shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal proceeding shall be instituted exclusively in the judicial courts of Ontario.
